PAYMENT AND REFUND POLICY
- Paid Services
- Certain features, tools, storage limits, or services offered on the Platform may be available only upon payment of applicable fees (“Paid Services”).
- By subscribing to or purchasing Paid Services, you agree to pay the fees specified at the time of purchase.
- Pricing & Display
- Prices for Paid Services shall be displayed on the Platform and may vary based on the selected plan, duration, or features.
- Prices may be displayed in different currencies based on the user’s geographic location, selected market, or billing preferences. Unless otherwise expressly stated, all prices are exclusive of applicable taxes, duties, or governmental charges.
- Billing Cycle & Subscription
- Paid Services may be made available under various subscription plans, including monthly, quarterly, semi-annual, annual, or usage-based models, as determined and displayed on the Platform at the time of subscription.
- Subscription fees shall be billed in advance at the beginning of each billing cycle.
- Subscriptions may automatically renew unless cancelled before the renewal date.
- Payment Methods
- Payments may be made through third-party payment gateways integrated with the Platform.
- Yavanika does not store credit/debit card details and is not responsible for payment gateway failures.
- Taxes & Invoicing
- Applicable taxes including GST shall be charged as per Indian law.
- A tax invoice or payment receipt shall be made available electronically upon successful payment.
- Failure of Payment
- If payment fails or is reversed, Yavanika reserves the right to:
- Suspend access to Paid Services
- Downgrade the account to a free plan
- Terminate the account after reasonable notice
- Continued use of Paid Services without payment constitutes a breach of this EULA.
- Cancellation by User
- Users’ may cancel the subscription at any time through users’account settings.
- Cancellation shall take effect at the end of the current billing cycle and any outstanding fees will become immediately due and payable.
- Refund Policy
- Fees paid for Paid Services are non-refundable, except:
- Where mandated by applicable law
- In case of technical failure attributable solely to Yavanika
- If the User cancels the subscription after a billing period has started, no refund (including proportional or prorated refund for unused days) shall be provided for that billing period, except where a refund is mandatorily required under applicable law.
- Refunds, if approved, shall be processed within a reasonable period (within 5-7 business days) through the original payment method.
For the purpose of this clause, “Technical Failure” means a material malfunction, error, or outage of the Platform’s core systems that:
- Prevents the User from accessing or substantially using the Paid Services;
- Persists for a continuous period exceeding 48 hours after written notification to Yavanika; and
- Is directly attributable to Yavanika’s internal systems, infrastructure, or software.
**Technical Failure shall not include:**
- Issues arising from the User’s device, internet connectivity, browser, third-party software, or hardware;
- Force majeure events;
- Scheduled maintenance notified in advance;
- Minor bugs, temporary slowdowns, or non-material performance issues that do not substantially affect service usage;
- Service disruptions caused by third-party service providers, payment gateways, hosting providers, or telecom operators beyond Yavanika’s reasonable control.
- Upgrade / Downgrade of Plans
- Users may upgrade or downgrade subscription plans subject to pricing differences.
- Upgrades may take effect immediately, while downgrades shall apply from the next billing cycle.
- Promotional Offers
- Yavanika may offer promotional pricing, discounts, or free trials at its discretion.
- Such offers shall be subject to additional terms and may be withdrawn without prior notice.
- Free Trials and Pilots
- Yavanika may offer a free trial or pilot to try our Service and Yavanika reserves the right to set eligibility requirements and the duration for free trials and pilots.
- At the end of your free trial, Yavanika will charge the relevant subscription fee for the next billing cycle to your nominated payment method, unless you cancel your subscription prior to the end of the free trial.
- If you have access to a free trial or pilot, your access to features made available as part of that free trial or pilot will cease if you do not enter into a paid subscription prior to the end of the pilot period.
- Price Revision
- Yavanika reserves the right to revise pricing for Paid Services.
- Any price change shall apply only to future billing cycles and shall be notified in advance where required.
1.12.3. Any increase in price will not apply until your next renewal or thirty (30) days after notice, whichever is later. If you do not wish to pay the increased price, you may cancel your subscription.
- Miscellaneous
- You represent and warrant that information you provide to us about your billing address will be current and accurate.
- You agree that Yavanika may contact you at any time by email, push notifications, or other method with information relevant to your subscription, billing, and use of the Service.
